Privacy Policy

​Article 13 – Identification

 

This Privacy Policy applies to all data collected by the Entities referred to in article 3, within the scope of their activities, through the programs they develop, the website ( https://www.elenaontheroad.com/ ), social media, newsletters, personal contacts, provided voluntarily to any employee of Timing or Associação Fórum Turismo. References to “data” in this Privacy Policy refer to any data submitted by the user who uses, has used or will use our services, whether questionnaire responses, data collected in a form or data entered on a website developed or generated by Associação Fórum Turismo, which is your proprietary data. References to personal information or just information shall mean information about you that we collect or of which we are custodians. Associação Fórum Turismo will be responsible for collecting and storing data, hereinafter referred to as Manager. Registration in TTL – Tomorrow Tourism Leaders presupposes acceptance of the Privacy Policy of the Associação Fórum Turismo. TTL – Tomorrow Tourism Leaders may be subject to image/video capture, so registration presupposes acceptance of image capture and sharing, for the purposes of promoting the project.

Article 14 – Protection of personal data

In accordance with the provisions of the General Data Protection Regulation (GDPR), the Manager recognizes the user's right to privacy, as well as that:

  • All data shared with the Manager was voluntary and is personal information, which the user accepts to be used by the Manager and gives his consent to process it;

  • The personal information that the user has shared or will share with the Manager will only be used after obtaining the user's acceptance of this privacy policy, and cannot be used in any way in violation of the law;

  • The Manager does not require you to share sensitive personal information, as defined in the GDPR;

  • The information provided will be used by the Manager only for purposes related to its business, that is, the programs or events it organizes;

  • After the purpose of using personal information has ended, the information is archived for the period of years provided for in the laws that govern the scope of services provided by the Manager and in accordance with what is stipulated in point 7 of this policy;

  • The personal information collected by the Manager is intended for use in the programs or events where it was collected and is appropriate to the reason that led to the collection;

  • Each user shares personal information voluntarily, and has the right to inspect, update, repair, block or request that it be deleted in accordance with point 8 of this policy;

  • The user has the right and duty to notify the National Data Protection Commission (CNPD), using the means available at  www.cnpd.pt , whenever they consider that there has been a breach of privacy by the Manager.

Article 15 – Who has access to data

 

The data provided by users is processed by the Manager's operational employees, only for the purpose set out in this privacy policy. Third-party companies, clients or partners of the Manager may also have access to the data, as long as they respect the GDPR and as part of the Manager's commercial operations.

Article 16 – Where data is stored

 

The data provided by users is stored in third-party databases, which comply with the GDPR, namely:

  • Google (Third-party database)

  • Facebook (Third database)

  • Instagram (Third database)

  • WhatsApp (Third database)

  • LinkedIn (Third-party database)

  • Typeforms (third database)

  • Whenever any of the databases described above are added or removed, the Manager will update this policy.

Article 17 – Stored information

 

For marketing and/or service purposes, we may request and store all information required during the TTL – Tomorrow Tourism Leaders initiative process.

Article 18 – Use of data

 

The data provided by users is used to:

To send commercial proposals;

  • To send information and direct invitations to programs and/or events that the Manager organizes;

  • The user gives consent to the Manager to use the data provided to keep him updated on the Manager's commercial and/or operational objectives.

  • The Manager agrees not to transmit or lend user data if the user has not accepted this privacy policy.

  • The Manager may not sell user data without individual written consent. For the purposes of commercial or operational purposes, the manager only sends emails to users who have accepted this privacy policy.

Article 19 – Period for which data is stored

 

All data will be kept for the years prescribed in the law that governs the operations to which the Manager's services fall. In the case of the internal Newsletter, this data will be kept forever or until the data subject requests to stop subscribing. When the data subject requests to stop subscribing, the Manager has a period of one week to delete the data from all databases that the data subject requests and inform the data subject of this deletion. All third-party databases have their information storage periods, and it is up to the user to check this information in the privacy policies of each of these third parties. By accepting this privacy policy, the user agrees that they are aware of the above point and that it is their responsibility to obtain information about storage periods from third parties.

Article 20 – Manage data

 

All data that you share with the Manager can always be deleted from the databases, via an email to ontheroad.with.elena@gmail.com, requesting their deletion.

Article 21 – Website security

 

The Manager is aware of the importance of security, therefore seeks to protect the user's personal information. Unauthorized access, use or disclosure is prevented by many security technologies and processes. The personal information that the user enters on the website is stored on a computer system with limited access in controlled locations. Whenever the Manager detects any case of data breach, it will act in accordance with the GDPR, and may even have to report these cases to the CNPD and, in case of high risk for the user, notify the user.

This privacy and data protection policy is in force from the moment it is posted on the website.

Cancellation policy

If you decide to cancel your tours, the following rules apply:

Tours in Porto: If the tour is canceled more than 2 days in advance, we will give you a full refund.
Workshops and tastings: If the tour is canceled more than 3 days in advance, we will give you a full refund.

Rescheduling tours

If changes are requested 10 days before the date of the tour, there will be no extra cost for rescheduling the tour and rescheduling can be done depending on the availability of the tour guide.


 

Cancellation of tours due to bad weather

Our tours operate in all weather conditions, except in cases of red warning issued by IPMA (Portuguese Institute of Sea and Atmosphere). However, we reserve the right to change an itinerary if weather circumstances so require, in order to provide you with the most comfortable and pleasurable tour possible.

Partial refunds

The situation is more complex if you book a tour for a group and one or more people decide to cancel. Prices for our tours are calculated based on the number of participants, and the greater the number of participants, the lower the price per person. This occurs because the cost is divided by the number of participants, therefore, the smaller the number of participants, the greater the contribution of each one above a certain number. Therefore, if one or more people decide to cancel, two possible scenarios may occur:

If you cancel less than 2 days before the tour date, there will be no refund of the corresponding amount.

If you cancel 2 or more days before the tour date, we will refund the money corresponding to the number of people cancelled. However, the price per person for the remaining participants will likely increase, so it will have to be recalculated and, if applicable, the difference will have to be paid by the person responsible for booking the group tour.
